On January 5, 2023, attorneys for Truist/Suntrust Bank filed an appeal of the recent DC Court of Appeals decision favoring the Plaza campaign.
This move further delays a trial at DC Superior Court (originally set to happen in 2018) where a jury of local DC residents would likely make permanent the public easement at this special corner of Adams Morgan.
Truist/Suntrust is now asking all Court of Appeals judges (en banc) to reverse the recent three-panel judgment substantiating the right of Plaza supporters to finally go to trial, slowing everything down once again.
Even though Court rules don’t allow for it, Truist/Suntrust asked for help from other parties and they found a strange suitor in D.C. Land Title Association & their counsel who submitted this Amicus Curiae brief below:
